RESOLUTION OF THE
MADISON COUNTY COMMISSION
WHEREAS,
the 2000 federal decennial census has been released; and
WHEREAS,
the Madison County Commission is at this time electing its members from
single-member districts pursuant to an order of the United States District
Court for the Northern District of Alabama in the Civil Action styled George
Grayson, etc. v. Madison County, Alabama, etc., Civil Action Number
84-V-5770-NE, entered on January 27, 1989, the provisions of Code of Alabama,
§ 11-3-1.1, and the resolution of the Madison County Commission adopted on
March 6, 1992; and
WHEREAS,
Code of Alabama, § 11-3-1.1, provides in pertinent part as follows:
(a)
Following the release of
any federal decennial census, any county commission of this state which is at
that time electing its members from single-member districts, pursuant to either
state or local law or a court order, may, by resolution, alter the boundaries
of the districts.
and
WHEREAS,
the Madison County Commission has advertised in The Huntsville Times, a
newspaper of general circulation in Madison County, for two consecutive weeks,
Friday, September 19, 2003, and Friday, September 26, 2003, that a resolution
altering the boundaries of existing Madison County Commission districts will be
considered by the Madison County Commission at the regular meeting of the
Madison County Commission to be held at 10:00 A.M. on Friday, October 3, 2003,
on the seventh floor of the Madison County Courthouse in Huntsville, Alabama,
which said advertisement included a map of the County indicating the proposed
district boundaries and notification that a map indicating the proposed
district boundaries is available for inspection in the lobby of the Madison
County Courthouse in Huntsville, Alabama; and
WHEREAS,
a public hearing in regard to the changes in the boundaries of existing County
Commission districts was held on Monday, September 29, 2003, at the Madison
County High School in Gurley, Alabama; and
WHEREAS,
attached hereto as Exhibits "A," "B" and "C,"
respectively, and made a part hereof as if set out in full herein, are
descriptions of the revised Madison County district boundaries by reference to
standard census units (Exhibit "A"), a description of each district
with reference to streets, roads, highways, rivers and other such features
(Exhibit "B"), and the total population and racial composition of the
population of each district pursuant to the 2000 federal decennial census
(Exhibit "C").
NOW,
THEREFORE, BE IT RESOLVED by the Madison County Commission that the boundaries
of the six Madison County Commission districts be and the same are hereby
altered so that the boundaries of the six Madison County Commission districts
to be used for the election of members of the Madison County Commission in the
2004 primary and general elections and thereafter shall be as provided on
Exhibits "A" and "B," which are attached hereto and made a
part hereof as if set out in full herein.
